Arbitration and mediation are forms of Alternate Dispute Resolution (ADR) intended to avoid the high cost and unpredictable outcomes that could result from going to court. But mediation requires parties to agree in the end, and if there is no agreement, there is no concrete result. Arbitration, also referred to as adjudication, is a process that results in a decision made by a neutral person who conducts a fair hearing outside the court process.
